Hire Ella

Hire Ella terms

Last updated: October 23, 2026

1. These terms

Hire Ella ("the Service") is provided by Fiscus Technology, LLC, a Texas limited liability company doing business as sethserver.com ("we," "us"). These terms apply to anyone who signs up for the Service ("you," the customer), in addition to the site's Terms of Service; where the two differ about the Service, these terms win. By ticking the box when you sign up, or by using the Service, you agree to them. If you sign up for a business, you agree for that business and confirm you may bind it.

2. What the Service does

Ella is an AI assistant. On errands you give her, she places phone calls, sends emails and, once your number is registered, sends texts to the contacts you name; she answers calls, emails and texts that come back to your Ella number or thread; and she reports to you what was said. Ella is software: she can mishear, misunderstand or summarize something wrongly. Check her summaries, transcripts and recordings before relying on them, and confirm any quote, price or commitment with the business directly before you act on it. Ella never commits you to anything beyond what your errand says she may agree to.

Every new account is reviewed by a person before Ella contacts anyone for it. We may decline an account for any reason, and nothing is charged for an account we decline.

3. Your account

  • One account per customer, signed in with a link sent to your email address. Keep that mailbox, and any API key or connected app (Claude, ChatGPT or your own scripts), secure: whatever is done with them is done on your account.
  • Your name, company, callback number, address and website are what Ella says she is calling for and may share. Keep them accurate. Don't give a name or company that isn't yours.
  • You must be at least 18 and in the United States. The Service is in English and uses US phone numbers.

4. Plans, billing and cancellation

  • Plans. Starter: 10 calls for $29 a month; Pro: 50 calls for $129 a month; Business: 200 calls for $399 a month. Included calls reset each billing period and don't roll over.
  • What counts as a call. An outbound call that reached a person or voicemail; a call to your Ella number; or an email or text thread with one contact on one errand, counted once, when Ella first sends or answers in it. Not counted: no answer, busy, a failed dial, a call under 20 seconds that never got past the greeting, or a call that dropped because of a fault on our side. A call over 10 minutes counts once for each 10 minutes started.
  • Extra calls past your plan's allowance are $3.50 each, billed on the same invoice at the end of the period. Your overage ceiling (default 25 extra calls, set by you from 0 to 1,000, or none) limits them: at the ceiling Ella stops starting new outreach, and calls to your number are still answered and counted.
  • Your number. Every account has one: toll-free $2.00 a month or local $2.50 a month, on the same subscription. We buy it when your account is approved. The number is provided for use with the Service; it isn't transferred to you, and we release it 30 days after your subscription ends.
  • Carrier and Twilio fees for registering your number for texts are passed on at cost, as a one-off charge on your next invoice.
  • When you're charged. You add a card through Stripe after you first sign in. Your subscription is held until your account is approved; the first billing period starts then. Subscriptions renew monthly until cancelled. Upgrades take effect at once (prorated); downgrades at the next renewal. Payments are processed by Stripe, under its terms.
  • Late payment. If a payment fails, Ella keeps working for 7 days, then stops starting outreach until it's paid.
  • Cancelling. Cancel at any time from Billing in your settings; it takes effect at the end of the period you've paid for, and fees already paid aren't refunded except where the law requires or we choose to. After it ends you can still sign in and read your dashboard.
  • We may change prices with at least 30 days' notice by email; a change applies from your next renewal after the notice.

5. Whom Ella contacts is your responsibility

You decide whom Ella contacts, and you are responsible for having the right to contact them. That includes complying with the Telephone Consumer Protection Act (TCPA) and the FCC's rules under it, the Telemarketing Sales Rule, CAN-SPAM, state telemarketing, "mini-TCPA" and call-recording laws, and the mobile carriers' messaging rules. Calls by an AI assistant are treated as artificial or prerecorded voice calls under the TCPA. This is not legal advice; if you're unsure whether an errand is lawful, ask your own lawyer before you start it.

Every errand says whom Ella is contacting:

  • Businesses. You confirm, for each errand, that every contact is a business, reached at a business phone number or address, about that business's own goods or services. If a contact says the number is a personal one, or asks not to be contacted, Ella stops and marks them, and you must not ask her to contact them again.
  • Individuals. You may ask Ella to contact a person at their own phone or address only if that person gave you their prior express consent to be contacted by an automated or AI assistant on your behalf (in writing, where the law requires it), and you record for each one where and when they agreed. Texts need that consent to cover texts. You must keep proof of that consent and give it to us if we ask. Sales, marketing or promotional calls or texts to individuals are not allowed at all.

Ella calls only between 8 AM and 8 PM in the contact's time zone, within the window you set. Anyone who asks Ella not to contact them again, or not to contact them for you, is put on a do-not-contact list: a list every account shares for people who never want to hear from Ella, and your own for people who don't want to hear from you. You must not try to get around those lists, the calling hours, or a contact's opt-out. National Do Not Call Registry scrubbing is not part of the Service; where the law requires it for your calls, that's yours to do before you give Ella the list.

6. Acceptable use

Every errand, and any change to your profile or an errand's script, is checked automatically before Ella contacts anyone, and some wait for a person to review them. The following are not allowed, and errands that look like them are refused:

  • debt collection of any kind, including reminders about money owed;
  • political, campaign, election or ballot calls, polls or surveys;
  • sales, marketing or promotional calls or texts to individuals;
  • anything harassing, threatening, abusive or deceptive, or calling someone who has asked not to be contacted;
  • impersonating anyone, including a government agency, a bank, a utility or another business, or asking Ella not to say she is an AI assistant;
  • emergencies: Ella is not an emergency service; call 911;
  • collecting card numbers, bank details, Social Security numbers, passwords, or health information;
  • anything unlawful, or anything that would require a license you don't hold.

The check is a safeguard, not a ruling that an errand is lawful: passing it doesn't move your responsibility to us. We may pause, refuse or cancel any errand, and suspend or close any account, if we believe it breaks these terms, risks harm to the people contacted, or puts our numbers or messaging registrations at risk.

7. What Ella says, and recordings

Every call Ella places opens with "Hi, this is Ella, an AI assistant calling for your name at your company. This call is recorded." Calls to your number are answered the same way. Her first text in a conversation names you and says she is an AI assistant, and every text conversation can be stopped by replying STOP (HELP for help). Her emails come from ella@reply.sethserver.com as "Ella for your name". Calls are recorded and transcribed, and you can hear the recordings and read the transcripts on your dashboard. You must not ask Ella to leave any of this out.

8. Texts

Ella texts from your number only once it's registered with the mobile carriers (A2P 10DLC for a local number, toll-free verification for a toll-free one). We submit the registration with the details you give us, which must be true; the carriers decide whether to approve it, and may take weeks or refuse. You agree to the carriers' rules for the use case registered, and that we may stop texting from your number if a carrier asks us to.

9. Data

We keep, for your account, the errands you give Ella, your contacts and their consent records, and the recordings, transcripts, summaries, emails and texts of her conversations. We use them to run the Service for you and to keep it safe and lawful (for example, to review a held errand or answer a complaint), and not to sell or advertise to anyone. The people Ella contacts for you are covered by our Privacy Policy, which says what we keep about them and who processes it. You are responsible for having a lawful basis to give us their details. Email sblack@sethserver.com to have your account's data deleted.

10. Connected apps and the API

You may connect Ella to Claude, ChatGPT or your own software with OAuth or an API key from your settings. Those apps act on your account with your authority, within these terms, and are subject to their own providers' terms. We may limit how often the API is called.

11. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DON'T WARRANT THAT ELLA WILL REACH ANYONE, GET ANY PARTICULAR RESULT, UNDERSTAND OR REPORT EVERY CONVERSATION CORRECTLY, OR BE UNINTERRUPTED OR ERROR-FREE, AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA OR GOODWILL, AND OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE FEES YOU PAID US FOR IT IN THE THREE MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to defend, indemnify and hold harmless Fiscus Technology, LLC and its officers, employees and agents from any claim, fine, damages, loss or expense (including reasonable attorneys' fees) arising from the errands you give Ella, the people you ask her to contact (including claims under the TCPA or any state telemarketing, messaging or recording law), the information you give us, or your breach of these terms.

14. Suspension and closing

We may suspend your account at once if we believe it's being used against these terms or the law, and close it with notice for any reason, refunding any fees paid for a period we don't provide. You may close it by cancelling your subscription and asking us to delete it.

15. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute is brought exclusively in the state or federal courts located in Texas.

16. Changes

We may change these terms. We'll email you about a material change at least 14 days before it takes effect; continuing to use the Service after that means you accept it. The date at the top says when they last changed.
