1. Introduction
This Privacy Policy describes how Fiscus Technology, LLC ("Company," "we," "us," or "our"), a Texas limited liability company, collects, uses, and shares information when you use sethserver.com (the "Site"). By using the Site, you agree to the collection and use of information in accordance with this policy.
2. Information We Collect
2.1 Information You Provide
- Email Address — When you subscribe to our newsletter, use the AI Advisor, submit a consulting intake form, or create an account.
- Name & Company Information — When you submit consulting intake forms or request proposals.
- Phone Number — If you agree to text messages, or give it to us to be called.
- Payment Information — When you purchase subscriptions, books, or digital products. Payment details are processed directly by Stripe and LemonSqueezy; we do not store your full credit card number.
- Conversation Data — When you interact with the AI Advisor, we store your conversation history to provide the service and improve responses.
- Shared Secrets — Content submitted through the secret sharing tool is encrypted. We do not have access to the plaintext content of shared secrets.
2.2 Information Collected Automatically
- Log Data — IP address, browser type, operating system, referring URLs, pages visited, and timestamps.
- Device Information — Device type, screen resolution, and browser capabilities.
- Usage Data — Pages viewed, time spent on pages, click patterns, and other interaction data.
- License Validation Data — Installation identifiers, software version, and validation timestamps for software license checks.
2.3 SMS & Mobile Information
Text messages come from Ella, Seth Black's assistant, and are sent on behalf of Fiscus Technology, LLC (dba sethserver.com). Ella texts about errands, appointments and requests she is handling with you, and sends the account owner account alerts and one-time verification codes. We never send marketing or promotional texts.
We text only people who agreed to it, in one of three ways: ticking the box on the SMS opt-in form (the box is never ticked for you), saying yes when Ella asks on a phone call whether she may text you, or texting Ella first, in which case she answers that conversation. Agreeing is never a condition of purchase or of anything else we provide.
We record the phone number, when and how you agreed, and, for the form, the wording you agreed to and the IP address and browser you used. We keep this as proof that consent was given, which our messaging provider and mobile carriers may require us to produce.
Ella uses AI model providers (such as Anthropic) to read your messages and write her replies. Message frequency varies. Message and data rates may apply. Reply STOP to any message to stop receiving them, or HELP for help.
2.4 Ella: Calls, Emails and Texts
Ella is an AI assistant who calls, emails and texts people and businesses for Seth Black: for example, to get quotes, book appointments, or answer someone who got in touch about something he's selling. If you speak or write with Ella, we keep:
- Call recordings and transcripts — Calls with Ella are recorded, transcribed, and summarized, including any offer or quote you give, questions you ask, and anything you ask her to send you.
- Emails and texts — The messages you exchange with Ella, and whether they were delivered.
- Contact details — Your name, business, phone number, and email address, from you, from a list Seth gives Ella, or from Seth's own contacts.
These are used to carry out the errand you were contacted about, to tell Seth how it went, and to follow up with you on it.
2.5 What Ella Remembers About the People She Deals With
So that later contact goes more smoothly, Ella keeps short notes on the businesses and people she deals with for Seth. There are two kinds:
- Contact statistics — Worked out from the last year of her calls and messages with you: the times of day you tend to answer, how quickly you usually reply by email or text, which of those you respond to most, and which phone menu options reached someone. Ella uses these only to choose a better time or way to reach you. They never make her contact you more often.
- Notes from conversations — Practical things you told her yourself, such as who to ask for, your hours, which phone menu option to choose, the services you offer, your standing terms (for example, a trip charge or a deposit), and how and when you prefer to be contacted. A note is kept only if it's backed by your own words from a call, email, or text. Seth may also add notes of his own.
Ella is built not to keep notes about health, disability, or age; family; religious or political beliefs; race, ethnicity, national origin, or background; money or legal trouble; opinions or judgments of anyone; home addresses; or account, ID, or card numbers: every note is checked by automated filters that refuse these, and anything that slips through can be deleted on request. Prices quoted for a particular job stay with that job and aren't kept as notes. Ella keeps no notes or contact statistics on Seth's family and friends. If we can't confirm that someone isn't one of them, nothing is learned about that person.
Notes are used only by Ella, only to contact you on Seth's behalf, and aren't shared with anyone else except the AI model providers that process them for her (see Section 5). Ella doesn't tell you what her notes say or share them with anyone else she contacts. Notes learned from conversations expire 4 to 12 months after they were last confirmed, depending on the kind, and are deleted within 30 days of expiring. A note that Ella learns is out of date is set aside and deleted within 6 months. Everything learned about you, notes and statistics alike, is deleted after two years without contact. Notes Seth writes himself are kept until he removes them.
You can ask us to delete Ella's notes about you, to stop her from keeping any, or to stop her from contacting you, by emailing sblack@sethserver.com. You can also tell Ella on a call or in a message that you don't want to be contacted again.
3. Cookies & Tracking Technologies
We use cookies and similar tracking technologies to operate the Site and collect usage data. The following third-party services place cookies or tracking pixels on your device:
3.1 Analytics
- Google Analytics (G-E57W48V1GC) — Collects anonymized usage data to help us understand how visitors interact with the Site. Google's privacy policy applies. You can opt out using the Google Analytics Opt-out Browser Add-on.
- ClickHouse — Self-hosted analytics for internal performance monitoring and content analysis.
3.2 Advertising & Conversion Tracking
- Google Ads (AW-1055867823) — Conversion tracking for advertising campaigns.
- Meta Pixel (848952668552939) — Tracks conversions and enables remarketing on Facebook and Instagram.
- LinkedIn Insight Tag (7515076) — Tracks conversions and enables remarketing on LinkedIn.
- Reddit Pixel (a2_h9vuhnxd1hj6) — Tracks conversions and page visits for Reddit advertising.
3.3 Essential Cookies
- Session Cookie — Required for authentication and CSRF protection. Expires when you close your browser or after your session times out.
4. How We Use Your Information
We use collected information to:
- Provide, maintain, and improve the Site and its services.
- Send newsletter emails and content updates you've subscribed to.
- Process payments and manage subscriptions.
- Respond to consulting inquiries and generate proposals.
- Provide AI Advisor responses and improve the advisor's accuracy.
- Validate software licenses and track installations.
- Analyze Site usage and performance.
- Detect and prevent fraud, abuse, and security incidents.
- Comply with legal obligations.
5. How We Share Your Information
We do not sell your personal information. We may share information with:
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with anyone, other than the messaging provider that delivers the messages you agreed to, and only for that purpose.
- Payment Processors — Stripe and LemonSqueezy process your payment information to complete transactions.
- AI Service Providers — Conversation inputs to the AI Advisor are sent to third-party AI model providers (such as Anthropic, OpenAI, and Google) to generate responses. These providers process data according to their respective privacy policies and data processing agreements.
- Ella's Service Providers — To place and take calls and to send and receive texts, Ella uses Twilio, which also stores call recordings. Speech is turned into text and back by speech providers such as Deepgram and Cartesia. What you say or write to Ella, and her notes about you, are sent to AI model providers such as Anthropic, OpenAI, and Google (in some cases through Inworld, which routes requests to them) to understand it and write her replies. We use API access, which these providers don't use to train their models by default. Ella's emails go through Google (Gmail). Amazon Web Services stores call recordings, documents, and logs, and sends Seth's notification emails. Our servers are hosted by Linode (Akamai).
- Seth Black — Ella works for Seth Black. He sees what she records about calls and messages with you, and her notes.
- Email Service Providers — Your email address is shared with our email delivery provider to send newsletters and transactional emails.
- Analytics & Advertising Partners — Usage data is shared with Google, Meta, LinkedIn, and Reddit as described in Section 3.
- Legal Requirements — We may disclose information when required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
6. Data Retention
- Account Data — Retained for as long as your account is active or as needed to provide services.
- Email Subscriptions — Retained until you unsubscribe.
- SMS Consent Records — Retained while you remain opted in, and afterwards for as long as we may be asked to evidence that consent was given.
- Conversation Data — AI Advisor conversations are retained to provide service continuity and may be periodically purged.
- Ella's Calls and Messages — Recordings, transcripts, summaries, and messages are kept as a record of the work Ella did, until you ask us to delete them or we no longer need them.
- Ella's Notes — As described in Section 2.5: notes from conversations expire 4 to 12 months after they were last confirmed and are deleted within 30 days of expiring, notes found to be out of date are deleted within 6 months, and everything learned about someone is deleted after two years without contact.
- Shared Secrets — Automatically expire and are deleted according to the expiration period set at creation.
- Payment Records — Retained as required for accounting and legal compliance.
- Analytics Data — Retained according to each analytics provider's data retention policies.
7. Data Security
We implement reasonable technical and organizational measures to protect your information, including:
- HTTPS encryption for all data in transit.
- Encryption of shared secrets at rest.
- Password hashing for user accounts.
- CSRF protection on all forms.
- Rate limiting on API endpoints and the AI Advisor.
No method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.
8. Your Rights — California Residents (CCPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with the following rights:
- Right to Know — You have the right to request that we disclose what personal information we collect, use, disclose, and sell about you.
- Right to Delete — You have the right to request the deletion of your personal information, subject to certain exceptions.
- Right to Opt-Out of Sale — We do not sell your personal information. If this changes, we will provide an opt-out mechanism.
- Right to Non-Discrimination — We will not discriminate against you for exercising any of your CCPA rights.

8.1 Categories of Personal Information Collected
In the preceding 12 months, we have collected the following categories of personal information:
- Identifiers — Name, email address, phone number, IP address.
- Commercial Information — Purchase history, subscription status.
- Internet or Network Activity — Browsing history on the Site, search history, interaction data.
- Professional Information — Company name, job title (from consulting intake forms), and business details you give Ella, such as your services, hours, and terms.
- Audio and Electronic Information — Recordings and transcripts of calls with Ella, and the emails and texts you exchange with her.
- Inferences — Ella's contact statistics (Section 2.5): when you tend to answer and how you prefer to be reached.
9. Children's Privacy
The Site is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us at sblack@sethserver.com and we will promptly delete it.
10. Third-Party Links
The Site contains links to third-party websites and services. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit.
11. AI-Specific Privacy Practices
When you use the AI Advisor:
- Your conversation inputs are sent to third-party AI providers to generate responses.
- We store conversation history to maintain session context and improve the service.
- Do not share sensitive personal information (passwords, financial details, medical information) in AI Advisor conversations.
- AI providers may process your inputs according to their own data handling policies, though we use API-level access which typically excludes training on your data.
12. Do Not Track
The Site does not currently respond to "Do Not Track" (DNT) browser signals. However, you can control tracking through your browser settings, cookie preferences, and the opt-out mechanisms described in Section 3.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the updated policy.
